Lotus cancelled my order

Interesting, that means that a Section 75 chargeback is technically possible, given it's not absolutely a part-payment and therefore not part of a payment over £30k.

Back when I paid it clearly stated 'Thank you for paying your Emira deposit' and no copy of terms was provided.

I've taken a slighly different tack for now - speaking to Lotus CC today they confirmed they are FCA regulated, also verified on the FCA register, so I've raised a formal complaint on lack of refund and will follow the FCA complaints process and FOS if required. https://www.emiraforum.com/threads/uk-refunds-following-cancellation.2353/#post-71328
 
However the Emira really isn't going to be making much in overs to be worth doing. Those on Autotrader aren't exactly zooming out of the showrooms in any kind of rush.
This is true and I think it shows just how price sensitive the Emira is going to be. At 60-80k it kinda makes sense for a new car in a niche category, but it doesn't have the pull for 90-100K. That price bracket gets you into some very interesting cars, particularly if you're not bothered about buying used. I've already decided that one more delay or screw up and I'm going for a gen 1 R8 V10 manual.

But then you get into the old vs new debate. 90-100k does buy some nice 4 year old motors but thats the rub they are 4 years old. After running them for say another 3 years they are seven years old and not many people want to run a 7 year old super car due to parts pricing.

Its always swings and roundabouts. Someone else has taken the hit with depreciations versus having to run an older car etc. I'm only expecting to do around 6-8k per year as it's my second car and my thinking is that I'd get a manual R8 Gen 1 (prefer the styling over gen2) and allow a good initial 'refurbishment' budget to get it in A1 condition, buying the best that I could get for the money in the first place.

I think it’s a good option. I’d be lying if it wasn’t something I was expecting. MK1 manual V10 R8 will for sure be a desirable classic in the future. It’s just sometimes difficult to find them in a none dull old man colour 😂
 
I like that this discussion seems to be about consumer protection laws and low demand for a car with a two year waiting list and not about how scalpers and flippers bring zero to the table. Good on Lotus for trying to stop this practice and ensuring that the people buying it don't have to pay some stupid markup just because a person who didn't even want the car, only the scalping money, bought it first.
